This is the first national study of its kind that investigates the trajectories of wrongful convictions as systems failures by examining decisions from investigation to exoneration. Wrongful conviction is a significant social and legal problem in Australia and other nations. It costs the Australian government millions in police, court and prison services and has health and psychological consequences for exonerees and their families. Expected outcomes for this project include an early warning detection tool to identify at-risk cases and overall improved accuracy in convictions. This will provide significant benefits, for criminal justice agencies, victims and accused individuals while positioning Australia as a world leader in the field.Read moreRead less

This project aims to investigate one of Australia’s most pressing social problems: domestic violence and the emerging use of digital technology to enact and escalate abuse and stalking. Technology-facilitated domestic violence threatens psychological, emotional and physical wellbeing and safety (and signifies risk of homicide), and so warrants attention. Justice systems have a crucial role to play in preventing technology-facilitated violence and safeguarding and empowering victim/survivors. This timely project seeks to assess existing State responses to and regulation of such harms. It expects to provide an evidence base to enhance and develop innovative policing and judicial policy and practice, with benefits to communities and economies.Read moreRead less

This project aims to undertake the first national study to investigate longitudinal trends in the history of interpersonal violence in Australia. Interpersonal violence is a major national challenge and violence prevention is a policy concern. By analysing case-level data for ten thousand criminal prosecutions over modern Australian history, the project will assess long-term trends in violent events and their relation to historical change. Tracking the rise and fall of prosecuted violence, the project will test current scholarly understanding about the history of violence, yield new insights about historical victimisation, and provide a critical background for understanding contemporary violence.Read moreRead less

This project aims to comprehensively map the regulatory pathways that innovative health technologies must navigate from the laboratory to the clinic, and to identify areas of over and under regulation. Pathways for innovative procedures, medicines and devices will be analysed in three cutting edge case studies - genome editing, biologic medicines and bio-printing - with particular focus on therapeutic goods registration and patents. Doctrinal, qualitative and iterative research methods will be used. The primary intended outcome is a set of recommendations to assist policy makers in ensuring consistency of regulatory policy and practice, thereby supporting innovation and safe clinical translation, for the benefit of all Australians.Read moreRead less

The Legal Regulation of Behaviour as a Disability. People who exhibit socially challenging behaviour are increasingly defined in law as having a disability. This project explores the problem of how law should respond to this growing cohort, a problem that becomes more acute as advances in genetics and the brain sciences expand the set of socially unacceptable behaviours that are identified as biologically based. Using detailed case studies of the regulation of genetic screening of embryos for disability and the application of disability discrimination law to behavioural traits, the project is expected to determine how, if at all, law should regulate variant personality and behaviour.Read moreRead less

This project applies a widely respected approach to analysing governance systems to global problems of carbon emissions and sustainable development generally. Its significance lies in the centrality of the problems addressed and the adaptation of the widely praised NISA (National Integrity Systems Assessments) approach from domestic to international spheres. It aims to: adapt NISA to apply to a global sectoral problem of major significance; map and assess the Global Carbon Integrity system; identify gaps, weaknesses and areas on non-collaboration; provide suggestions for improvement; provide a fresh and useful perspective on global problems applicable to other issues. Investigating the Coronial Determination of Suicide as a Category of Death. Data for suicide statistics can only come from official findings of suicide by a coroner, but this is a finding they are often reluctant to reach. The purpose of this project is to investigate how statistical calculations of suicide are dependent upon its coronial determination. The research is not only expected to result in more defensible national suicide data, it also aims to clarify the degree to which the recurrent ....Investigating the Coronial Determination of Suicide as a Category of Death. Data for suicide statistics can only come from official findings of suicide by a coroner, but this is a finding they are often reluctant to reach. The purpose of this project is to investigate how statistical calculations of suicide are dependent upon its coronial determination. The research is not only expected to result in more defensible national suicide data, it also aims to clarify the degree to which the recurrent 'problem' of suicide data may lie in the coronial construction of suicide itself. Expected benefits of the project include the clarification of the role of the coroners regarding suicide determination, and the more effective targeting of suicide prevention programs.Read moreRead less
