This causes lifelong psychological, social and economic cost to victims. It also undermines Australia's social fabric, and costs the nation hundreds of millions of dollars annually. Early intervention promotes enhanced health and life outcomes for abused children, and teachers are well-placed to contribute to early reporting of child ....Teachers Reporting Child Sexual Abuse: Towards Evidence-based Reform of Law, Policy and Practice. Every year, thousands of Australian children are sexually abused. This causes lifelong psychological, social and economic cost to victims. It also undermines Australia's social fabric, and costs the nation hundreds of millions of dollars annually. Early intervention promotes enhanced health and life outcomes for abused children, and teachers are well-placed to contribute to early reporting of child sexual abuse. This research promotes children's healthy start to life by being the first inquiry to identify the most effective legal and practical strategies for requiring and enabling teachers to accurately report child sexual abuse. It adds further economic and social benefit by finding ways to reduce inaccurate reports of child sexual abuse.Read moreRead less

. Technology has the potential to transform the means for scholarly collaboration and communication. Our proposal will achieve this potential, by deploying open source infrastructures to create new communication platforms. The Initiative will itself use collaborative writing systems to construct and energise the Network, which will match researchers requiring these new technologies with those who have the skills to build them. The outcomes will be an increase in the efficiency of traditional research collaborations as well as new kinds of collaboration and communication, for researchers and consumers of research across a range of disciplines.Read moreRead less

Last year in Queensland 2700 Coronial internal autopsies were conducted at a cost of $5.3 million. In addition to the economic cost, other relevant concerns include few qualified personnel, public health risks, and cultural and religious sensitivities associated with internal autopsy. Anecdotal evidence suggests that for a number of these deaths, the internal autopsy was not necessary to establish cause or circumstance of death. The purpose of this research is to create guidelines to enable coroners to weight all sources of evidence before ordering internal autopsies The purpose is to decrease the number (and associated costs, risks and distress to families) of unnecessary internal autopsies being performed without compromising the finding as to cause and circumstance of death.Read moreRead less

Over the past decade, Australian Legal Aid Commissions have reduced the number of grants for legal representation, while introducing a range of new services, many of which are designed to assist clients to solve their own dispute out of court, or to undertake much of the work associated with court proceedings themselves. The project will subject these new services to independent evaluation and scholarly analysis. Its results will provide a valuable input into the future development of legal aid policy and services, and assist in achieving a desirable and cost-effective balance between litigation legal aid, 'outside litigation' and self-help options.Read moreRead less
Legal Responses to Systemic Injuries: Towards a New Paradigm for Compensation. This research aims to identify better and fairer ways for the legal system to respond to systemic injuries, such as the taking of indigenous children from their families, or widespread abuse of children in institutional settings. This research aims to identify better and fairer ways for the legal system to respond to systemic injuries, such as the taking of indigenous children from their families, or widespread abuse of children in institutional settings. The tort system is under attack from various quarters: in this context, its failure lies in its focus on harms that happen on a one-to-one, rather than a systemic basis. The research will review redress schemes established in other countries (most notably Canada and Ireland) with a view to developing better and more appropriate legal responses to widespread contemporary harms.Read moreRead less
Improving online case law within the constraints of free access through heuristic linking and resulting discovery mechanisms. Better interconnections between cases and between cases and other documents, will improve the work of the judiciary, lawyers and legal researchers. Improved speed, accuracy and comprehensiveness of assessment of the legal implications of previous cases should result in better quality client advice and judicial decisions. The general public and business, for whom AustLII is the principal means of accessing law, will also benefit from better understanding of, and easier access to, the interconnections between the sources of law. Free access via AustLII's increasingly comprehensive coverage of Australian Courts and Tribunals means these innovations will be of immediate broad national benefit.Read moreRead less

An effective regime of electoral law and regulation is vital to the integrity of any democratic system. The litigation arising from the recent US Presidential election clearly demonstrates this. But electoral law is a neglected discipline in Australia. This impedes best practice electoral administration and the orderly development and modernisation of electoral law norms and rules. With the involvement and backing of Electoral Council of Australia (representing all Australian electoral authorities), this project will produce leading scholarship that will assist the ongoing development of an appropriate regime of electoral law for Australia in the 21st century.Read moreRead less

The executive branch of government is the central actor in protecting Australia from terrorism and crime, as it is in other countries. The executive is also central to defence, immigration control as well as critical domestic policy domains. Understanding the nature and scope of executive power, and how it is regulated and rendered accountable, is therefore vital to good governance and successful protection of Australian interests. This project will provide the first integrated, broadly-based and comparatively-informed analysis of executive government under the Constitution since the emergence of Australian constitutional nationalism in the High Court in the 1990s and since the executive assumed expanded powers in the post 9/11 world.Read moreRead less
