Undocumented Migrants- Unearthing Knowledge on a Key Source of Farm Labour. The Australian horticulture industry has endemic labour challenges, both in terms of labour supply challenges and a systemic problem of non-compliance with labour standards. A core component of both problems is the entrenched reliance on undocumented migrants. Given complex supply chains transiting fresh fruit and vegetables from the farm to the consumer, undocumented workers are largely invisible. There is very little research on undocumented workers on farms. Addressing this critical Australian and international knowledge gap, this project is the first study to comprehensively analyse the role of undocumented migrants in the horticulture industry from a multi-stakeholder approach, involving government, employers and workers.Read moreRead less

This project aims to provide empirical and theoretical insights into the effective regulation of work-related rights and responsibilities of franchise workers, franchisees and franchisors. By combining comparative doctrinal analysis of labour and competition and consumer laws with mixed methods research, this project will expand our knowledge of the way in which public and private regulatory mechanisms influence the regulatory behaviour of key stakeholders. This will contribute to the development of a normative framework designed to inform enforcement strategy, policy-making and work quality within franchises.Read moreRead less

This project aims to examine the regulatory challenges relating to post-secondary work experience, such as internships, in the areas of labour and employment, anti-discrimination and workers compensation law in Australia. The analysis is designed to establish a global and comparative context, examining policy and regulatory responses in Canada, Europe (including Britain), New Zealand, and the United States of America and at the international level. By offering a comprehensive analysis of the theoretical and practical implications of law's boundary between work and education, it is expected to identify optimum approaches to the regulation of post-secondary work experience, and thereby expand policy debates and enhance future law reform.Read moreRead less
Reshaping employment discrimination law: towards substantive equality at work? The Australian employment discrimination law system comprises long standing anti-discrimination law and novel discrimination provisions from the Fair Work Act 2009. This project studies the operation and effectiveness of the reshaped system, to assess whether it is likely to be effective in supporting a more substantive version of equality at work.

Other outcomes will be to maximise Australia's labour supply and support efforts to prioritise social inclusion on the national agenda. The project will assist Australia to meet its international obligations and address human rights principles in relation to employment.Read moreRead less

This research will enable corporations to identify the points of greatest leverage over corporate and facility level health, safety, environmental and community (HSEC) performance and to develop strategies that successfully achieve their HSEC objectives. It will provide broader national benefits in (i) reducing workplace injury and environmental degradation at multiple facilities across Australia and (ii) increasing productivity and economic benefits (by doing so at reduced cost to companies). The study will also benefit the Australian and regional communities by identifying strategies that facilitate better community-company relations. Read moreRead less

This project examines an under-researched area of vital importance to the effective implementation of workplace regulation. It investigates the way in which business organisations respond to four areas of labour regulation (covering occupational health and safety, unfair dismissal, equal opportunity and harassment). To what extent do these areas of regulation have the capacity to bring about changes in the culture, policies and operating procedures of organisations? What obstacles that impede organisations? attempts to comply with the regulatory requirements? The project will result in the usual academic publications, and workshops for the government agencies administering the legislation involved in the study.Read moreRead less
Normalising Ability Diversity through Career Transitions:Disability at Work. This project aims to investigate how the higher education sector can better support people with disabilities to transition from economic exclusion to work. This project aims to investigate how the higher education sector can better support people with disabilities to transition from economic exclusion to work. One in five Australians have a disability and of these 47.3% are not employed. This is a significant issue with regulatory failures and challenges often affecting rights to education and work being exercised on an equal basis. This project seeks to examine international legal norms, theories and strategic and operational practices in the higher education sector. Expected outcomes include advances in scholarship on ableism, informed policy reform, and transferable operational processes for the education and employment sectors, to improve the transition of people with disabilities to work.Read moreRead less

Employment deprivations are hardships often consequent upon findings of criminal guilt and additional to criminal sanctions imposed by the courts - a convicted person may be dismissed from employment or ineligible to apply for certain jobs, particularly public sector positions. There are no settled legal principles governing inter-play between criminal behaviour and employment status and opportunities. Unfairness may result, as the offence effectively attracts a 'double' punishment; an offender's rehabilitative prospects are impeded; social and economic burdens ensue.
The project aims to develop comprehensive policy guidelines concerning the appropriate connection between criminal behaviour and employment status for courts, governments and employers.Read moreRead less
